What a landlord can deduct from a rental deposit

The Netherlands is the most specific: only proven repair costs and unpaid rent or service charges, with a written breakdown to the tenant. Norway lists rent owed, damage, moving-out costs and other lease claims, and Austria allows only justified claims from the tenancy. Ontario goes a different way: the landlord applies the deposit to the last rent period and must ask the Board for any damage or arrears. None of the ingested statutes defines normal wear and tear.

Countries not in this table yet

Sweden and Japan (no deposit rule in the ingested acts), the United States, Australia and France (no tenancy deposit statute ingested). No ingested statute defines normal wear and tear, so that question is not answered here.

How this table was built

Every row is taken from the official, consolidated text of the statute, which LawAsked loads from each government’s legislation service.

Each figure is tied to a passage quoted word for word from that text. When the page is served, it checks that every quoted passage is still in the current text of a law that is in force; if a law is amended and its wording changes, that row is hidden until a person reviews it again.

The table shows the statutory minimum only. Collective agreements, awards and individual contracts often give more than the statute, and some countries let a collective agreement set different terms.
