Maternity leave by country
The statutes in this table give a mother anything from 12 weeks (the United States) to 12 months (Australia) away from work around a birth, and they differ most on what she may not skip. Austria and Germany forbid work in a fixed period before and after the birth, although the German mother can waive the six weeks before it. In Japan the weeks before the birth start only when she asks. Norway fixes six weeks after the birth, Spain six of its 19, and Sweden two of at least 14, while Canada forbids the employer to force leave on her. Every row is read from the statute and quoted in its own language.

- The statute bars the employer from employing the mother in both periods, so the weeks are compulsory in the sense that work is forbidden, not merely allowed.
- The post-birth period is lengthened when the pre-birth eight weeks were cut short, up to a maximum of 16 weeks after the birth (§ 5 Abs. 1).

- Section 73 lets the employer require unpaid leave in the 6 weeks before the birth only when the employee gives no fit-for-work certificate, or a certificate saying she is unfit or should not stay in her position. The statute sets no fixed compulsory weeks.

- Section 208 lets an employer require leave only when the employee cannot perform an essential function and no suitable job is available, and only for that time.

- These sections give the pregnancy leave and the six weeks after the birth. Further parental leave is in § 12-5 and is not part of this table, so no total is shown.

- Employment Rights Act 1996 ss 71, 72

- The employer commits an offence if it lets an employee who meets the prescribed conditions work during the compulsory period.

- Family and Medical Leave Act 29 U.S.C. § 2612
- Federal law only. The 12 workweeks are one total for all family and medical reasons in a 12-month period, covering the birth of a child, not a separate maternity entitlement, and apply to an eligible employee, a term defined elsewhere in the Act.
- The Act says the leave may consist of unpaid leave. It does not say when the leave starts relative to the birth, and it sets no compulsory period.

How this table was built
Every row is taken from the official, consolidated text of the statute, which LawAsked loads from each government’s legislation service.
Each figure is tied to a passage quoted word for word from that text. When the page is served, it checks that every quoted passage is still in the current text of a law that is in force; if a law is amended and its wording changes, that row is hidden until a person reviews it again.
The table shows the statutory minimum only. Collective agreements, awards and individual contracts often give more than the statute, and some countries let a collective agreement set different terms.
