Who decides when you take your holiday, by country

No statute here gives the employee a free choice of dates. Austria, Australia and Spain start from agreement between the two sides, and Spain sends an unresolved disagreement to the labour court. Germany, the Netherlands and Norway have the employer decide, but must weigh the employee's wishes, and in the Netherlands silence from the employer for two weeks makes the employee's dates stand. Sweden and Norway set the notice at two months, while France lets an employer change dates up to one month before. Rules on a continuous block range from 12 days in Germany and France to four weeks in a Swedish summer.

Countries not in this table yet

The United States and the United Kingdom are missing: the federal US statutes loaded (FLSA, FMLA) set no annual leave, and the UK Employment Rights Act 1996 does not govern the timing of leave; the UK Working Time Regulations, which do, are not loaded.

How this table was built

Every row is taken from the official, consolidated text of the statute, which LawAsked loads from each government’s legislation service.

Each figure is tied to a passage quoted word for word from that text. When the page is served, it checks that every quoted passage is still in the current text of a law that is in force; if a law is amended and its wording changes, that row is hidden until a person reviews it again.

The table shows the statutory minimum only. Collective agreements, awards and individual contracts often give more than the statute, and some countries let a collective agreement set different terms.
